How does the BSP pilot differ from the operator?

Pursuant to Commission Implementing Regulation (EU) No 2019/947, an unmanned aircraft operator is any legal or natural person operating or intending to operate at least one unmanned aircraft system. The term “GNP pilot” is defined in Regulation (EU) No 2018/1139 of the European Parliament and of the Council and means a natural person who is responsible for the safe conduct of an unmanned aircraft flight by manual control of the flight or, where an unmanned aircraft is automatically flying, monitors its course and maintains the ability to: to intervene and change course

What is LUC?

LUC – means an aircraft operator certificate for light aircraft systems, i.e. a certificate issued to the operator of an unmanned aircraft system by the competent authority in accordance with Part C of the Annex to Commission Implementing Regulation (EU) No 2019/947. The abbreviation LUC is derived from the English name Light UAS Operator Certificate.

Do you always have to carry out a risk analysis on a special flight?

Pursuant to Article 5 of Commission Implementing Regulation (EU) No 2019/947, the operator of an unmanned aircraft is to obtain an operating licence from the competent authority of the Member State in which it is registered in accordance with Article 12 of that Regulation. In the case of Poland, it will be the President of the Civil Aviation Authority.

Before submitting an application for an operating licence to the competent authority in accordance with Article 12, the operator shall carry out a risk assessment in accordance with Article 11 and submit it together with the application together with appropriate risk mitigation measures.

When the operator of an unmanned aerial system makes a declaration to the competent authority of the Member State of registration in accordance with Section UAS.SPEC.020 as set out in Part B of the Annex does not require an operator of the unmanned aerial system referred to in paragraphs 1 to 4 of this Article to operate under the standard scenario set out in Appendix 1 to the Annex and the procedure set out in Article 12 (5) shall apply. The system operator of the unmanned aircraft shall use the declaration set out in Appendix 2 to the Annex.

    The aim of the project is to promote scientific research in the field of the law of new technologies by disseminating knowledge of the legislation on unmanned aerial vehicles – drones – in particular their operation, design, the obligations of operators and pilots, the obligations of public actors in the field of electromobility and the support mechanisms for users.
